A project manager made an advance payment "on behalf of his employer company", our client, to its contractor which was in financial difficulties, in order to ensure the construction work carried out as scheduled. Later, the employee tried to recover the payment from his employer and the contractor. The court of first instance gave the judgement to the claimant, whist Xinxiang Municipal Intermediate People's Court of Henan found there were insufficient evidence to support the employee's claim and therefore supported our client's appeal to have dismissed the employee's claim.
